According to a ruling of the Saarlouis Administrative Court, Saarland officials have a claim to a claim for potency-increasing drugs if a medical diagnosis has been carried out in advance.

In the future, Saarland officials will be entitled to financial assistance for sexual enhancement. This was decided by the Saarland Administrative Court in Saarlouis. This applies if patients can prove a medically diagnosed potency disorder.

According to a ruling of the administrative court Saarlouis, officials of the state of Saarland have potency-increasing medicines. Some officials filed a lawsuit in court after medically proving that they had potency disorders. The official allowance had previously refused to take over the drug costs. The explanatory statement stated that the statutory health insurances would provide sexual enhancers in their catalog of benefits. This view was contradicted by the administrative judges. Finally, the official allowance excludes the reimbursement of the costs of medicinal products only if they are not sufficiently scientifically recognized. That would not happen here, since the effects were sufficiently clinically tested. Furthermore, the aid only applies if a doctor has previously confirmed that the condition is dysfunctional. This must be submitted to the aid. Case numbers of the judgments: 6 K 751/10, 6 K 728/10 and 6 K 1440/09.

Recognized disease dysfunction
In a previous judgment, the same court had already confirmed that erectile dysfunction was a serious illness of those affected. Therefore, subsidies must be granted by the defendant, which also includes drugs such as Viagra, Cialis and Levitra. The defendant can appeal the decision of the Administrative Court before the Higher Administrative Court. The judgment is therefore not yet final. (Sb)
