Hartz IV: Jobcenter takes sanction against pregnant women after an emergency application at the social court

Job Center Braunschweig has taken back the 100 percent Hartz IV benefit cut of a pregnant woman with immediate effect. With the help of a lawyer, the person concerned had filed an emergency complaint with the competent social court. The social court advised the authority to take back the sanctions, since already the conclusion of the one-euro job had already been unlawful. The job center then turned it down and rejected the benefit cut. We reported.

The massive reduction in benefits to zero euros of a pregnant woman from Braunschweig had sparked protests in numerous publications and Internet blogs. The job center had sanctioned the Hartz IV control benefits for three months to zero euros for a young woman because the person concerned refused to take up a one-euro job because of her existing pregnancy and a generally poor state of health. But the authorities saw no reasonable reason not to start the action. In a letter to the woman, the authorities said the view that a „Shortening of the sanction period“ is not an option since there would be an interest of the general public in carrying out the sanctions. In her distress, the person concerned turned to the Jobless Forum Germany, where they immediately provided legal assistance.

Compared with the initiative, the woman was relieved. In recent days, they have been due to sanctioning „felt like a criminal“. The last days would also have been a heavy burden. The Unemployment Forum pointed out that lawsuits against sanctions are often successful. So Martin Behrsing said: „If those affected us legally against sanctions, the sanctions are almost always taken back“, said Martin Behrsing, spokesman for the unemployed group.
