The district court Oldenburg rejected the complaint of a man against a brewery. Because he had drunk a moldy beer in a restaurant, the plaintiff demanded an allowance of 2000 euros. In the course of legal aid, the injured party wanted to force a payment from the brewery. According to the man it came already in February 2013 to the consumption of the beer of the mark Jever. After noticing that the beer was full of mold, the man complained of nausea and vomiting. The brewer then apologized to the man and asked him for a brewery tour and a towel as compensation.
But that was not enough for the plaintiff. A spokesman for the court said that the complaint was rejected in September, on the grounds that it was a triviality and was not entitled to compensation for pain. In the verdict, the court said that the consumption of beer did not harm the well-being of the man. In addition, the brewery's reaction, which offered him redress, does not give rise to a justified claim. (Fr)
