Mistakes in clinic treatment are by no means uncommon, but rarely do they reveal such culpable behavior that legal liability of clinics, doctors or nurses follows. The case was different with a woman who fell into a coma after a supposedly harmless plastic surgery. Here, the Mainz district court has now decided on a liability of the responsible physician, the clinic in Mainz and a medical student.
To what extent the defendants are liable, the court wants to determine after further evidence. Significant fines could come together because the patient's husband claims more than 800,000 euros in damages for the care of his wife. After undergoing beauty surgery in 2011, the student falsely administered an anesthetic during her vigil for the mother of two, causing her to fall into a coma. For this she has not awakened until today.
In such a case, the family member changes his or her entire life situation as a result of the treatment error. The enormous care effort is difficult to accomplish without technical support. However, the cost of doing so often goes beyond the budgets of households. Equally important for the relatives is a financial compensation, with which they can cover at least part of the costs. However, the claim for damages often ends in a year-long legal dispute, the outcome of which remains uncertain. In the current case, however, the plaintiff can now at least hope for a certain amount of damages. (Fp)
