Compensation for 16 items in the body after surgery
14/01/2013
Treatment errors are not uncommon in hospitals in Germany, but the current allegations against a hospital in Hannover clearly go beyond the known scope. In the past, individual cases had caused a sensation in which a foreign body was forgotten after an operation in the patient's body. In Hanover, there are now 16 items that were discovered after an operation in the body of a now deceased patient.
How 16 objects in the course of an operation can get into the body of a patient, without this attracting the presence of medical personnel, is not only for the relatives of the deceased and their lawyer an unresolved issue. All that is certain is that months after the operation in Henriettenstift in Hannover numerous foreign bodies such as a needle in the body of the 74-year-old H. Brecht were discovered. The responsible chief physician, however, made all the blame to the local press. In a tough dispute, which now continues the widow of the deceased in April 2012 patient, it must be clarified, which guilt the doctors of the hospital actually meets.
80,000 euros compensation demanded by Henriettenstift
Actually, the patient in Henriettenstift only an artificial intestinal output should be placed, but the accusation of the lawyer of the then 74-year-old, according to the man several foreign bodies were implanted simultaneously. Six months after the operation, 16 items have been discovered in the patient's body, according to medical law expert Annette Corinth. The dispute over responsibility and compensation is ongoing. The family of the now deceased calls in his name continues to receive an appropriate compensation, the insurance of the attending physician, however, initially allegedly only for the payment of 500 euros have been prepared. Meanwhile, there is a sum of 15,000 euros compensation in the room, which the insurance should be willing to pay. But the survivors continue to demand a sum of 80,000 euros and announced in case of doubt, to sue in court. The dispute between the insurance of the Henriettenstiftes or the operating physician, the VGH, and the patient in whose body the objects were discovered, has been taking place since 2010, whereby the family doctor had also attested to the man that severe treatment errors significantly worsened his Health condition led.
Pieces of a compress, needle and bandage discovered in the patient's body
The lawyer of the patient, who died in April 2012, told the „Hannoversche Allgemeine Zeitung“ (HAZ) said that after the operation in 2009, he had to be re-operated after a bad finding in a rehabilitation clinic. For months more and more foreign bodies such as a piece of compress, a needle or bandage have been found in the body of the patient. The medical lawyer described the extent of the foreign bodies found as „unique in medical literature.“ The previous offer of the insurance for the payment of 15,000 assessed the medical law expert as "far too low" and instead demands "in the name of the daughter and the widow of the patient 80,000 euros pain compensation". The lawyer sees the Henriettenstift in the duty to prove that the objects were not the reason for the fatal disease course of the patient. Corinth's argument that the materials found were postoperative items that could not enter the patient's body during the procedure was not followed by Corinth's assessment, but rather "pure stalling tactics".
