According to estimates by the Robert Koch Institute (RKI), for example, at the end of 2013 around 14,000 Germans were unknowingly infected with HIV. This also represents a great danger for the sexual partners. In Munich, a man is now in court, which is said to have infected a woman with HIV.

Woman demands 110,000 compensation for HIV infection
As the news agency dpa reports, a woman in a civil case at the Higher Regional Court in Munich demands 110,000 euros in compensation from the man who reportedly infected her with HIV.

According to the information, the district court had awarded the plaintiff in the previous instance the money, the man defends itself against the verdict.

It is said that the court was convinced that the woman had "almost certainly" caught on sex with the man with the virus that can trigger the immune deficiency disease AIDS.

In court, therefore, an expert should be heard on the question of the time of infection.

Accused referred to existence of a negative test
According to dpa, the district court assumed that the man was not sure that he was HIV positive, "but because of the overall circumstances he had been aware that there was an increased risk for an infection".

In addition, the Court of First Instance believed that the applicant stated that before the sexual intercourse the man stated that he had had an AIDS test which had been negative.

According to the agency, the Higher Regional Court has stated that it is likely to come to a similar assessment as the district court. In the assessment of damages and compensation for pain and suffering, however, may be a complicity of the applicant to be considered.
