Trial of an HIV-infected person on World AIDS Day

02/12/2010

Ironically, on yesterday's World AIDS Day, a trial in front of the Weseler Schöffengericht against an HIV-infected should take place. According to the court, according to the court, the trial date was not scheduled for World AIDS Day. However, the court hearing broke because the accused had not appeared.

At the Schöffengericht Wesel on World Aids Day an HIV-infected person should be made the case. The defendant is accused of being guilty of dangerous personal injury. The prosecution accuses the 36-year-old man of having had unprotected intercourse with his girlfriend even though he already knew about his HIV infection. From the sexual act also a common child, who was born in April of this year, was born. However, the accused did not appear at the court hearing, so now an arrest warrant was issued. A new date for the hearing would not be found before March 2011, according to the court. A re-infection of the woman or the child did not take place, so the judge. However, the accused had known of his infection long before. In a police interrogation, the man had already admitted this fact. Neither the injured party had filed a complaint, nor has anyone come to harm health. But why does the trial take place anyway??

The case was not reported by the girlfriend herself, but by the local immigration office. Since the accused was "illegally in Germany", the authority had searched for him. The foreigners authority would have been unclear whether the man comes from Liberia or from Nigeria. Most recently, the defendant stated that he was a Nigerian. A survey of the University Hospital Essen on the HIV infection came to light through investigations by the authorities' employees at the responsible Federal Office. The court dealt with the case because the defendant was living in Hamminkeln at the time and allegedly made false statements about his current whereabouts. So, first and foremost, it seems as though one wants to prove to the man that the child was conceived for the purpose of residence status. The responsible prosecutor told RP Online: The man had "made his residence permit with the child".

Now, in our view, there is a suspicion that the man wants HIV infection „Dingfest“ do. There is no clear correlation between the two facts in our view. In the case of a conviction, the man is likely to face deportation and, according to the Criminal Code, a sentence of 6 months' imprisonment. Depending on the circumstances of the act, intent or reasons, the sentence is mitigated or increased. We will continue to report. (Sb)
