A pharmacist in Bonn, who had repeatedly made a criminal appearance, was now deprived of license and operating license. Among other things, he had attacked people with a caustic phosphoric acid solution from his laboratory.
Several times criminally appeared
A pharmacist, who violates the general professional duty of his profession because of committed acts of violence, can be deprived of the license and operating license, as the Administrative Court of Cologne (Az .: 7 K 7077/11 and 7 K 3907/12) announced. A pharmacist from Bonn, who appeared criminally twelve times between 1990 and 2004, had sued after the district government of Cologne had withdrawn his license to practice medicine and the city of Bonn to operate the pharmacy.
Guests splashed with phosphoric acid solution
The 45-year-old had been convicted, inter alia, because of a significant act of violence against his then girlfriend to a total custodial sentence of two years and nine months. He had mistreated the woman and threatened to kill her. In addition, the Regional Court of Bonn convicted him of dangerous bodily harm in two cases to a total custodial sentence of fourteen months without parole. The pharmacist had sprayed two guests in a Bonn restaurant with a corrosive solution of phosphoric acid from his laboratory, which he had previously raised in three syringes.
Offended against the general professional duty of a pharmacist
The district government of Cologne justified the revocation of its approval with the unreliability and unworthiness of the man. The city of Bonn had issued the operating permit, without knowing of the last act. The complaints of the man against the withdrawal of the license and his operating license, however, remained unsuccessful. In the conviction of the court, the plaintiff no longer guarantees the proper performance of his profession. As the court said, he had seriously violated the general professional duty of a pharmacist to use the substances and substances available in the pharmacy only responsibly and in accordance with their pharmaceutical purpose.
Exclusively for the benefit of the patients
A pharmacist is expected by the public to use the accessibility of hazardous substances exclusively for the benefit of patients and not abuse it for criminal purposes. He also guilty of substantial misconduct by deliberate attack with the phosphoric acid solution, which would lead to a serious loss of reputation and trust. As the court further substantiated its judgments, the man lacked the suitability to practice the profession of pharmacist or pharmacist, as he does not shrink from using also on hazardous substances from pharmacies.
